GROUND RETURN

WITHDRAWAL RIGHT

Pursuant to Article 49(1)(h) of Legislative Decree No 206 of 6 September 2005, the consumer may withdraw from the contract within 14 days from the date of receipt of the products without any particular reason being required, as mere change of mind is sufficient.

In order to exercise your right of withdrawal, you must inform us of your decision to withdraw from the purchase contract by means of an explicit statement (e.g. letter sent by post or e-mail).
To comply with the withdrawal period, it is sufficient to send the communication concerning the exercise of the right of withdrawal before the expiry of the withdrawal period.

If you withdraw from this contract, you will be refunded all payments you have made to us, including the costs of delivery (with the exception of additional costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed of your decision to withdraw from this contract. Such refunds shall be made using the same means of payment as was used for the initial transaction, unless expressly agreed otherwise; in any event, the customer shall not incur any costs as a result of such refund. The refund may be suspended until receipt of the goods or until the consumer has demonstrated that he has returned the goods, whichever is the earlier.

without undue delay and in any event within 14 days of the day on which you notify us of your withdrawal from this contract. The deadline is met by returning the goods before the expiry of the 14-day period.

The direct cost of returning the goods will be borne by the customer

The shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer. In case of damage of the goods during transport, Armeria Amelio Gamba srl shall inform the customer, who shall file a complaint against the courier chosen by him in order to obtain the refund due; in this case the product shall be sent back to the Customer and the request for withdrawal shall be cancelled.

The right of withdrawal is totally void, due to lack of the essential integrity of the goods (packaging and/or its content), in cases where Armeria Amelio Gamba srl ascertains:

1) the absence of the outer packaging and/or the original inner packaging;

2) the lack of items supplied with the product or faults in the product itself;

3) the damage of the product for causes different from its transport. In case of forfeiture of the right of withdrawal, Armeria Amelio Gamba srl shall return the purchased goods to the Customer, charging the same for the shipping costs.

Please note that it will not be possible to exercise the right of withdrawal for purchases made with a VAT number (this presupposes a professional use of the goods, which is outside the scope of the legislation protecting the consumer as a private end user).

4) It will NOT be possible to return products if the packaging has been opened inside (e.g. you can open the outer packaging of the courier, but not the packaging containing the product.

Goods must be sent in a rigid box, as they may be damaged if sent in an envelope.
The following must be enclosed with the shipment:
1. the purchase identifier, i.e. the invoice/purchase document obtained with the order,
2. an indication of the reason for the return (shipping error, defective article, right of withdrawal).

We recommend that you pay the utmost attention to the protection and packaging of the goods to be returned.

Please also note that we will not accept any returns on delivery.

After receiving the returned goods, Armeria Amelio Gamba srl shall send the Customer the amount due within 14 working days.

Complaints regarding damage/manufacturing defects that occur more than 14 days after the date of purchase will only be considered positive if accompanied by the invoice or a copy of the original order.

Complaints concerning damage occurring during transport shall only be considered on the basis of a complaint protocol completed in the presence of the bearer of the goods (postman or carrier’s agent).

Prices, orders and payments

The ordered products will be processed and dispatched from our headquarters as quickly as possible, but we would like to emphasize that this is a preorder, and the maximum delivery deadline should still be considered as October 2023.

Armeria Amelio Gamba srl is not directly responsible for any delays in delivery beyond the mentioned deadline. In the event that the products are not available in stock, the buyer will be notified, and a decision will be made together on how to proceed.

The products are shipped through the Italian postal service and a private courier and are sent to the address indicated at the time of the order as the shipping address.

The payment methods currently accepted are: Credit card, Giropay, Sofort, IDeal and, in some cases, bank transfer.

All products can be shipped within the European Union (please check costs during checkout).

For some products, a valid identity document must be attached to the order (or subsequently, within 3 calendar days, by email) in order to complete the order process.
This document serves only to confirm the purchaser’s age and will not be kept longer than necessary to complete the shipment of the products.

Company responsibility and complaints.

We go to great lengths to ensure that the information on the site is always up to date. But unfortunately we cannot guarantee its 100% accuracy at all times and we do not take responsibility for any errors, especially if they have occurred during catalogue updates etc. Any inaccuracies in amounts or, for example, shipping address etc, can be resolved by telephone call or email (preferred). For any errors or larger complaints, please contact us only by email at armeria-gamba@libero.it or in paper form at Armeria Amelio Gamba srl, via Cao Prà 60, 37060 Lugagnano (VR) Italy, all complaints regarding transport by the Italian postal service or courier (e.g. goods damaged during transport) should be sent to the nearest post office or courier office and also forwarded to us immediately, so that we can solve the problem quickly.

We also remind you that the buyer assumes legal responsibility for the possession of the products ordered. This means that if the customer orders a product that is illegal in his own country (or in the country to which it is shipped) Armeria Amelio Gamba srl will not be responsible for any legal or other problems related to the order.

Reimbursement by the Italian postal service

If you notice products that have been damaged, are missing or have been opened, you can request a refund from the Slovenian postal service. As soon as your request is fulfilled, you will be refunded monetarily or a new item will be sent to you. We will work together with the Italian postal service to solve your problem as quickly as possible.

Courier refund

If you have received the products via courier and you notice damaged, missing or opened products, you can submit a claim for a refund. This request must be made within 7 days of receipt of the goods to armeria-gamba@libero.it and must be accompanied by photos of the damaged products, the DPD tracking number and a brief description of the problem.

If you are not satisfied with our products, you can return them to us undamaged and in their original packaging within 10 days of receipt by sending them to the following address: Armeria Amelio Gamba srl, via Cao Prà 60, 37060 Lugagnano (VR) Italy. We recommend that you use a traceable form of shipment and pack the products carefully. Shipping costs are always borne by the sender of the goods unless otherwise agreed.

Data security

We guarantee that the company Armeria Amelio Gamba srl will respect your privacy, according to the Italian law (which refers to the EU directives). We guarantee the security of your data and that such data will only be used for the purpose of processing orders and informing you of promotions and the like. We only retain data that you provide to us voluntarily, by email, by telephone, by answering online questionnaires or when placing an order.

Normally, the personal data we have access to are:

• First name, last name and address
• Email and telephone number
• Digital copy of a valid identity document (only for some products)

Without your consent, we will never disclose your data to third parties, either for free or for a fee. The only ones who will receive your data (except for identity documents) will be forwarding agents, for obvious reasons. You can at any time request the deletion of your data from our files and request changes to your personal data. Your personal data will be retained in accordance with the law and may only be disclosed to third parties not required to process your order in the event of a court order.
